For many of the 14 passengers on the Viaggidea tour bus, visiting America was a dream. The Italian tour group had spent a day sightseeing in New York City and was scheduled to visit Niagara Falls, Toronto, Washington D.C. and Philadelphia. However, the long awaited trip came to an unfortunate end when the driver of a tractor trailer veered into the wrong lane.

The fatal bus accident occurred at about 10:00 am on Wednesday, June 3, 2015. Fifty-five year old Franklin Wyatt of Macomb, Oklahoma was driving a tractor trailer south on I-380 when he veered into the northbound lanes and hit a northbound tractor trailer driven by Virginal Dockery of Augusta, Georgia. The impact caused Wyatt’s truck to spin across the median and crash head-on into the chartered tour bus occupied by tourists from Italy who were seriously injured and some were killed.

The cab of the tractor trailer detached and landed in the woods at the side of the road. The driver sustained only minor injuries. The driver of the bus and two passengers were killed at the scene. Four passengers were flown to trauma centers in critical condition.

The Bus Safety Lawyers at Ostroff Injury Law Fight for Italian Bus Accident Victims

Only 18 months ago, another bus/truck crash occurred in Pennsylvania, on a nearby highway and location to this crash. Our law firm is currently involved in representing the estate of the passenger who died in this crash and 22 other badly injured passengers.

In the U.S., operators of commercial vehicles must drive responsibly and must follow federal and state safety laws. When these laws are violated, the driver and the company he works for are liable for any injuries and deaths that occur. As a passenger on the bus, you have a right to seek compensation for your medical bills, pain and suffering, damaged property, loss of income, and any additional expenses that you incurred because of the accident, including travel and hotel costs. If you lost a loved one in the accident, you may be eligible for additional compensation.

The truck driver’s insurance company will be contacting you about insurance payments. However, the insurance company’s goal is to increase its profit by paying you is little as they can. They will not advise of all your rights. They will not tell you that you need to file a claim to receive full compensation. They may tell you that you have no rights at all because you are not a citizen.

You have the right to be paid fairly for the serious injuries you suffered. If you were badly injured, you could be entitled to very, substantial compensation, regardless of your citizenship status. Before you talk to the insurance company, talk to a local Pennsylvania attorney with a reputation for suing and winning bus accident and truck accident claims.
